The Federal Court of Justice (BGH) dismissed the plaintiff's application to suspend proceedings and rejected their complaint against the non-allowance of appeal, thereby upholding the decision of the Hanseatic Higher Regional Court and leaving it in force, with the plaintiff ordered to bear the costs of the appeal proceedings. The dispute arose in a civil matter where the plaintiff challenged the lower court's refusal to permit a revision appeal, arguing that the case possessed fundamental legal significance or required further legal development. The court found that the matter lacked fundamental significance and did not require a decision by the court of revision to ensure uniform legal doctrine, relying on its prior judgment of February 27, 2024, and applying the procedural provisions for the non-allowance of appeals under § 543 Abs. 2 Satz 1 ZPO, while waiving further reasoning pursuant to § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO.
