Legislator-Zusammenfassung

KI-generiert

The Federal Court of Justice admitted the plaintiff's revision complaint limited to the appellate court's reversal of the first-instance judgment, which had ordered the defendant to pay €43,000 plus interest and return the vehicle, while the broader non-admission of the complaint was rejected without detailed reasoning. The dispute concerns a contract for the sale of a vehicle, where the plaintiff challenged the appellate court's decision to dismiss their claim after the defendant appealed the lower court's monetary judgment. The decisive legal basis for the court's procedural order is § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, which permits the court to omit a detailed justification for its decision on the non-admission complaint, alongside cost allocation rules under § 97 Abs. 1 ZPO and § 544 ZPO governing the partial successful appeal.
