Waiver of hearing complaint fees under § 21 GKG and denial of legal aid due to statutory inadmissibility of the underlying appeal
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH), 8th Civil Senate, dismissed the applicants' request for a renewed case file review and declared their cost objection moot, resulting in no party prevailing on the merits as the procedural requests were denied. The dispute concerned a procedural application for fee remission and file access following a prior decision regarding legal aid and the admissibility of a hearing complaint (Anhörungsrüge). The court ruled that the hearing complaint was hopeless from the outset because the underlying legal appeal (Rechtsbeschwerde) was statutorily inadmissible under the grounds previously cited, thereby negating the basis for granting legal aid under § 114(1) sentence 1 of the Code of Civil Procedure (ZPO), while applying § 21(1) sentence 3 of the Court Costs Act (GKG) to waive court fees for the hearing complaint procedure.
