The Federal Court of Justice (IX Civil Senate) dismissed the debtor's objection to a cost assessment of €120, thereby upholding the original invoice. The dispute arose from a complaint regarding a court fee calculated under the Courts and Fees Act (GKG), where the debtor argued that a subsequent judgment in an unrelated criminal case relieved them of the financial obligation; although a judicial officer had previously reduced the fee to €60 based on specific procedural criteria, the debtor's appeal sought full relief. The court held that the scope of an objection to a cost assessment is strictly limited to reviewing the administrative fee-setting process and does not extend to challenging the substantive merits or the underlying binding judgment of the case in question. Relying on § 66 GKG and the doctrine that cost objections cannot review the underlying decision, the court determined that the criminal matter was legally irrelevant to the civil cost assessment and ruled that no further costs or fees would be awarded in the objection procedure.

[GRUENDE]

I. Mit Beschluss vom 14.
