Inadmissibility of legal appeal against interim injunction decisions due to statutory limitation of jurisdictional path
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the applicant's legal appeal as inadmissible, thereby upholding the lower appellate court's rejection of the immediate complaint and leaving the initial district court's denial of the application intact. The dispute concerned an application for an interim injunction, which was initially rejected by the district court and subsequently upheld by the regional court of appeals upon immediate complaint. The BGH held that the legal appeal was not statable because, under § 542(2) sentence 1 of the Code of Civil Procedure (ZPO), decisions ordering, amending, or lifting an arrest or interim injunction are not subject to revision, and this limitation on the jurisdictional path likewise precludes a legal appeal against an appellate court's decision rendered by order in such proceedings.
