The Federal Court of Justice (BGH) granted partial admission of the plaintiff's non-approval complaint against the appeal court's decision of March 16, 2023, specifically for the portion of the appeal that had dismissed the claim for €22,271.25 plus interest, while rejecting the complaint as unfounded for the remainder, thereby leaving the lower court's decision on the calculation of the imputed usage benefit in force; the case involved a civil dispute where the plaintiff failed to sufficiently demonstrate that the appellate court's reasoning regarding the height of the deductible usage advantage met the threshold for revision on grounds of fundamental significance, further development of law, or legal uniformity, pursuant to § 543(2) sentence 1 ZPO, with the plaintiff bearing the costs of the unsuccessful parts of the proceedings based on a dispute value capped at €6,000 for court fees and €30,000 for attorney fees (allocated 20% against the defendant).
