Denial of legal aid for legal complaint and dismissal of judicial officer recusal motion based on statutory evidence demands
Legislator-Zusammenfassung
KI-generiertThe BGH 8th Civil Senate denied the plaintiff's application for legal aid to file a legal complaint against the Landgericht Heidelberg's decision and dismissed the plaintiff's request to recuse the responsible judicial officer as inadmissible. The dispute concerned the admissibility of a legal complaint in a civil procedure where the plaintiff failed to demonstrate a sufficient prospect of success, while simultaneously challenging the judicial officer for allegedly mishandling the legal aid application by requesting specific evidentiary documentation. The court held that the legal complaint lacked merit under § 114(1) sentence 1 ZPO and determined that the judicial officer's demand for evidence was a lawful discharge of official duties under §§ 10, 28 RpflG in conjunction with §§ 117(1) sentence 1, 118(2) sentences 1, 2 ZPO, thereby rejecting the recusal motion under §§ 41 et seq. ZPO.

Februar 2022 - VIII ZR 182/21, NJW-RR 2022, 518 Rn. 14; vom 17.
