Non-admission of complaint in building association dispute over third-party use of distinct property unit as fitness studio
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the non-admission complaint filed by the plaintiffs, leaving the Landgericht München I judgment of July 29, 2021, in force and ordering the plaintiffs to bear the litigation costs (32% and 68%) based on a dispute value of €39,500. The dispute concerned a claim for the cessation of use of a distinct property unit within a building owned by the defendant as a fitness studio, with the valuation calculated at 5% of the respective market values of the plaintiffs' units. The court denied admission under § 543 Abs. 2 ZPO, determining that the case raised no questions of fundamental legal significance and that no decision was required for the development of law or to ensure uniform jurisprudence, while citing § 47 Abs. 2 Satz 1 GKG regarding the objective determination of the dispute value in appeals.

1. Die Nichtzulassungsbeschwerde der Kläger gegen das Urteil des Landgerichts München I - 36. Zivilkammer - vom 29.
Dezember 2021 - V ZR 112/21, ZWE 2022, 141 Rn. 5).
