Admissibility of cost objections requiring qualified electronic signatures in legal hearing objection proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 8th Civil Senate dismissed as inadmissible the complainant's objection to the court's cost assessment, thereby upholding the assessment of €66 in court fees against the complainant. The dispute concerned the procedural costs arising from a prior decision that had dismissed the complainant's objection to a hearing as inadmissible. The court ruled that the complainant's email objection was procedurally defective because it failed to comply with the formal requirements of a qualified electronic signature or secure transmission path under § 5a GKG and §§ 130a(3)(4) ZPO. Consequently, the initial cost assessment, based on a fixed fee of €66 pursuant to No. 1700 of the GKG Cost Schedule and the complainant's status as the applicant under §§ 22(1), 29(1) GKG, was confirmed as legally correct.

Die Erinnerung der Beschwerdeführerin vom 3. Mai 2024 gegen den Kostenansatz des Bundesgerichtshofs vom 23. April 2024 (Kassenzeichen 780024123232) wird als unzulässig verworfen.
[GRUENDE]
I. Mit Beschluss vom 30.
