Legislator-Zusammenfassung

The Federal Court of Justice (BGH) dismissed the defendant's complaint as inadmissible, upholding the lower court's decision and leaving the original judgment in force. The dispute concerned a civil proceeding where the defendant had attempted to appeal the Landgericht's dismissal of its appeal for lack of legal representation. The BGH ruled that the complaint was filed in violation of mandatory procedural requirements, specifically failing to be submitted by an attorney authorized before the BGH, and also lacked the requisite legal significance or need for legal development to justify federal intervention. Key legal provisions cited include § 78(1) and § 78b(1) of the Code of Civil Procedure (ZPO) regarding mandatory counsel and appointment of a mandatory lawyer, as well as § 574(2) and § 575(1) ZPO concerning the prerequisites and deadlines for filing an appeal (Rechtsbeschwerde) against a procedural dismissal order.

Volltext

Mai 2020 - I ZB 5/20, juris Rn. 4 und vom 7. Juli 2020 - XI ZB 1/20, juris Rn. 2). Die einmonatige Frist zur Einlegung (§ 575 Abs. 1 Satz 1 ZPO) ist am 5. Januar 2023 abgelaufen.
