The German Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-allowance of revision, ordering the plaintiff to bear the costs of the complaint proceedings and upholding the lower court’s decision. The dispute concerned the enforceability of a specific insurance policy model and the defense of estoppel (venire contra factum proprium) within a civil liability context. The court determined that neither the case had fundamental significance nor did it require the development of law or uniform judicial interpretation under § 543 Abs. 2 Satz 1 ZPO; specifically, it held that the compliance of the policy model with EU directives was not decisive for the outcome and that a preliminary reference to the Court of Justice of the European Union regarding estoppel was unnecessary, citing established case law on the exhaustion of domestic legal remedies.

BVerfGK 19, 467, 475; 18, 105, 111 f.; 6, 79, 81 ff.).

Der Kläger trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
