The Federal Court of Justice (5th Criminal Senate) granted the defendant's application for reinstatement to the position prior to the expiration of the appeal deadline against the Landgericht Berlin's verdict of September 28, 2022, with the application processed at the defendant's expense. The case involved a procedural challenge where the defendant sought to rectify a missed revision deadline following the delivery of a criminal judgment. The court determined that because the lower court had issued a complete and validly served judgment, no return of the file for amendment or re-service was necessary; consequently, the deadline for filing the written reasons for the revision begins upon service of this reinstatement decision, applying the general procedural framework for appellate deadlines in criminal matters.

Volltext

BGH, Beschluss vom 19. Juni 2019 – 5 StR 18/19).
