The Federal Court of Justice dismissed the defendant's complaint against the non-admission of revision, leaving the appellate court's judgment in favor of the plaintiff in force and assigning the costs of the appeal to the losing defendant. The dispute concerned a fee claim based on architectural and engineering services, where the defendant had argued that the relevant statutory fee regulations were unconstitutional due to violations of the debtor's fundamental rights. The court held that the case lacked fundamental legal significance under § 543 Abs. 2 Satz 1 Nr. 1 ZPO because the defendant could not rely on an alleged unconstitutionality of § 7 Abs. 1 and 5 of the Regulation on Fees for Architectural and Engineering Services (HOAI) of July 10, 2013, to justify admission of the appeal.

§ 543 Abs. 2 Satz 1 Nr. 1 ZPO

The main ground for dismissing the complaint, as the court determined the case lacked the fundamental legal significance required to admit the appeal to the Supreme Court.

§ 544 Abs. 6 Satz 2, 2. Halbsatz ZPO

Procedural rule applied to justify the court's decision to omit a detailed reasoning in the dispositive, as it would not contribute to clarifying the conditions for admitting an appeal.

§ 97 Abs. 1 ZPO

Basis for the cost order, assigning the costs of the complaint proceedings to the losing defendant.

Volltext

Halbsatz ZPO).

Die Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
