Non-admission of civil revision and refusal of preliminary reference under Art. 267 TFEU on damage causation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Justice (BGH) rejected the plaintiff’s complaint against the non-admission of revision and declined his request to stay the proceedings, leaving the appellate court’s decision of April 25, 2022, in force. The dispute involved a civil case where the plaintiff challenged the lower court’s refusal to admit revision, arguing for a preliminary ruling by the Court of Justice of the European Union under Article 267 TFEU. The BGH determined that the matter lacked fundamental legal significance or a need for uniform jurisprudence under Section 543(2) Sentence 1 ZPO, and specifically held that the appellate court’s independent reasoning on damage causation was not amenable to a preliminary reference, thereby denying the request for a stay pursuant to procedural independence principles.
