The Federal Court of Justice (BGH) 9th Civil Senate dismissed the applicant's petition for legal aid and the appointment of a counsel ex officio, thereby denying access to the Rechtsbeschwerde (appeal against a non-appealable decision) procedure. The dispute involved a challenge to a decision issued by the 12th Civil Senate of the Oberlandesgericht Stuttgart, where the applicant sought to overturn the lower court's ruling. The BGH held that the intended legal recourse lacked sufficient prospects of success and was procedurally inadmissible because the Rechtsbeschwerde was neither expressly provided for by statute under § 574 Abs. 1 Satz 1 Nr. 1 ZPO nor admitted by the lower court under § 574 Abs. 1 Satz 1 Nr. 2 ZPO. The court affirmed that, unlike in ordinary appeals, the non-admission of a Rechtsbeschwerde is not subject to separate review, nor is there a constitutional requirement for an extraordinary complaint pathway, leading to the rejection of the legal aid request under §§ 78b Abs. 1, 114 Abs. 1 Satz 1 ZPO.

Volltext

BGH, Beschluss vom 7. März 2002 - IX ZB 11/02, BGHZ 150, 133 ff) und verfassungsrechtlich auch nicht geboten (BVerfGE 107, 395 ff).
