The Federal Court of Justice (BGH) ordered the designation of the lead defendant as the counterparty to the representative appeal (Musterrechtsbeschwerdegegnerin) pursuant to § 21 Abs. 1 Satz 2 KapMuG, and recharacterized the joinder party’s separate legal appeal as a joinder to the representative plaintiff's appeal under § 20 Abs. 3 Satz 1 KapMuG, thereby consolidating the proceedings with the representative plaintiff’s position prevailing over the procedural status of the other appellants. This decision arose in a collective damages action under the German Capital Markets Model Case Act (KapMuG), where the procedural dispute centered on the proper configuration of parties and appeals following a first-instance judgment. The decisive legal basis relies on the specific procedural framework of the KapMuG for model proceedings, specifically the court's power to appoint the representative counterparty and its authority to reinterpret independent appeals as joiners to ensure uniform handling of the legal questions in the model case.
