Rejection of evidentiary motions based on lack of material significance in criminal proceedings
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (4th Criminal Senate) dismissed the defendant's appeal against the Landgericht Münster's judgment of June 22, 2023, leaving the conviction in force and ordering the defendant to bear the costs of the appeal. The dispute centered on procedural errors, specifically the trial court's rejection of three evidentiary motions that the defendant argued were improperly denied; the appellate review focused on whether these rejections constituted a legal error to the defendant's detriment. Relying on § 349 (2) StPO and § 244 (3) no. 2 StPO, the court determined the appeal was unfounded, holding that the trial court had correctly rejected the motions based on their lack of material significance (tatsächliche Bedeutungslosigkeit) and had provided sufficient specific reasoning for why the indicial facts did not support relevant conclusions, thereby validating the lower court's procedural decisions.

Volltext
BGH, Beschluss vom 19. Dezember 2018 – 4 StR 410/18, NStZ 2019, 294, 295; Beschluss vom 10. Oktober 2018 ‒ 5 StR 389/18, NStZ 2019, 232, 233; Beschluss vom 18. März 2014 – 2 StR 448/13, NStZ-RR 2014, 252, 253).
