Failure to demonstrate fundamental legal significance in civil damages litigation concerning the establishment of damage
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the appellate court's judgment and leaving the lower-instance decision in force. The dispute concerned a civil damages claim where the plaintiff challenged the appellate court's self-standing reasoning on the establishment of damage (Schadensbegründung) on grounds of procedural fundamental rights violations and the need for legal clarification under § 543 ZPO and Art. 267 TFEU. The BGH found that the complaint failed to demonstrate a fundamental legal significance or a need for the development of law or uniform jurisprudence, and rejected the alleged procedural violations as non-relevant; based on § 544 Abs. 6 ZPO, the court dispensed with a detailed justification as it would not contribute to clarifying the prerequisites for admitting revision. The plaintiff was ordered to bear the costs of the complaint proceedings, with a subject matter value set at up to €30,000.
