The German Federal Court of Justice (BGH), 11th Civil Senate, dismissed the plaintiff's complaint against the non-acceptance of leave to appeal, thereby rejecting the application for revision and leaving the decision of the Stuttgart Higher Regional Court of October 7, 2022, in force; consequently, the plaintiff bears the costs of the complaint proceedings. The dispute concerned a civil law matter where the plaintiff challenged the lower court's refusal to grant leave to appeal on the grounds that the case lacked fundamental legal significance and did not require the revision court to develop the law or ensure uniform jurisprudence. The court relied on § 543 Abs. 2 Satz 1 ZPO to find no legal basis for reviewing the appeal, referencing its prior precedent from January 23, 2018, and waiving further reasoning pursuant to § 544 Abs. 6 Satz 2 Halbs. 2 ZPO, while setting the subject matter value of the complaint proceedings at 42,319.54 euros.
