Scope of Joint and Several Liability in Value Replacement Forfeiture Orders for Multiple Co-Defendants
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Criminal Justice rejected the defendant's appeal as unfounded, upholding the Stuttgart Regional Court's conviction for commercial fencing and the determination that forfeiture of value replacement amounting to €36,220 was precluded by competing claims of injured parties. The dispute centered on whether the operative part of the judgment required clarification to specify the defendant's several liability in relation to joint and several liability with co-defendants regarding the total amount obtained. The appellate court declined to amend the judgment text, ruling that the existing operative text was sufficient because the reasons of the judgment already clearly articulated the specific amounts for which the defendant was jointly and severally liable for each individual act under the state's residual right of acquisition, rendering additional specification in the tenor unnecessary and noting that such clarification would not benefit the defendant. The decisive legal framework involved § 111i Abs. 2 and 5 StPO regarding value replacement and the state's residual acquisition rights, alongside §§ 349 Abs. 2, 349 Abs. 4, and 354 Abs. 1 StPO governing the rejection of appeals and the interplay between requests for clarification and the final rejection of legal remedies.

April 2015 - 4 StR 69/15; vom 25. September 2013 - 4 StR 351/13, NStZ-RR 2014, 16 und vom 29. September 2010 - 4 StR 435/10).
