The Federal Service Court of the Federal Republic of Germany (BGH Dienstgericht des Bundes) rejected all of the defendant's procedural challenges as inadmissible, thereby prevailing for the plaintiff. The defendant had filed motions for recusal against five judges and an objection regarding the denial of a hearing, challenging the court's composition and procedural fairness in a public service law dispute. The court held that the recusal motions were obviously inadmissible, particularly as they lacked a legitimate interest in legal protection regarding a judge who had already ceased to serve, and that the objection concerning the denial of a hearing failed to meet the stringent substantive requirements for demonstrating a violation of the right to be heard. The legal basis for the rulings rested on the absolute admissibility thresholds for recusal and hearing objections under § 63 Abs. 1 DRiG, § 3 BDG, and § 152a VwGO, as well as the doctrine that a judge's mere application of specific statutory conflict-of-interest provisions does not, in itself, create a reasonable suspicion of partiality.

September 2019 - IV AR (VZ) 2/18, WM 2020, 567 Rn.

12) ableiten will.
