Rescission of partner-arranging contract: applicability of pro-rata accounting under Art. 14(3) Directive 2011/83/EU and § 358(8) BGB
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the lower court's judgment and leaving the defendant's position intact. The dispute concerned the rescission of a partner-arranging contract and the plaintiff's challenge to the method of accounting for fees after termination. The Court determined that the legal issue did not possess fundamental significance and that the lower court's assessment was free from unreasonable doubt. The decisive legal basis involved the interpretation of Article 14(3) of Directive 2011/83/EU and Section 358(8) of the German Civil Code (BGB), which the Court held do not mandate the solely pro-rata time-based accounting method demanded by the plaintiff.

Die Beschwerde der Klägerin gegen die Nichtzulassung der Revision in dem Urteil des Hanseatischen Oberlandesgerichts Hamburg - 3. Zivilsenat - vom 2.
