Exclusion of public access for witness testimony on intimate matters and its impact on the validity of criminal conviction and sentencing
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the defendant's appeal against a criminal conviction, upholding the judgment of the Weiden regional court and ordering the defendant to bear the costs of the appeal proceedings. The defendant challenged the first-instance ruling on the ground that the trial court had unlawfully extended public access during the closing arguments, following the exclusion of three witnesses under Section 171b of the Code of Criminal Procedure (GVG) to protect their intimate personal sphere. The appellate court held the legal error unsubstantiated because the excluded witness testimony concerned personal matters unrelated to the charged offenses, thereby allowing the court to definitively exclude that the guilty verdict and sentencing were influenced by the alleged procedural violation; consequently, the original conviction remains in force.

BGH, Beschluss vom 26. Oktober 2016 - 5 StR 234/16).
