Inadmissibility of objection to hearing rights in legal complaint proceedings due to mandatory attorney representation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the applicant’s objection to hearing rights (*Anhörungsrüge*) as inadmissible, ordering the applicant to bear the costs. The dispute arose in a legal complaint (*Rechtsbeschwerde*) proceeding where the applicant, acting *pro se* via email, challenged a prior senate decision dated November 30, 2022. The court held that the objection was procedurally defective because the applicant failed to comply with the mandatory requirement to be represented by an attorney admitted to practice at the BGH in all proceedings before the court, including objections to hearing rights, citing § 321a(1) ZPO and § 78(1) Sentence 3 ZPO. The costs were allocated to the applicant under § 97(1) ZPO by analogy, and the court noted that no further response could be expected in response to additional submissions in this matter.
