Cost allocation and dispute value in withdrawn leave-to-appeal proceedings
Legislator-Zusammenfassung
KI-generiertThe plaintiff's motion for leave to appeal (Nichtzulassungsbeschwerde) against a lower court judgment was deemed lost after the plaintiff withdrew it, resulting in the lower court's partial and final default judgment becoming final; the plaintiff was ordered to bear the costs of the appellate proceeding. The dispute concerned a claim for the return of the purchase price, subject to a utility compensation deduction determined by the appellate court's discretion, following a second-instance judgment in a civil sales contract case. The Federal Court of Justice confirmed that the withdrawal of the motion constitutes a loss of the remedy, costs are allocated per §§ 565, 516 Abs. 3 ZPO, and the amount in dispute is capped at €80,000, rejecting arguments for a lower minimum value despite partial inadmissibility of the complaint under §§ 539, 338 ZPO and disregarding post-filing circumstances that did not align with established precedent.
