Dismissal of appeal against conviction; non-application of General Prosecutor’s request to correct guilty verdict despite established pathological condition of victim
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) 1st Criminal Senate dismissed the defendant's appeal as unfounded, upholding the Lower Regional Court Konstanz's conviction and ordering the defendant to bear the costs of the proceedings and the victims' necessary expenses. The dispute concerned the appropriateness of the sentencing conviction following a criminal trial, where the Federal Prosecutor General had argued for a correction of the conviction based on the victims' psychological sequelae, including sleep disturbances, anxiety, and concentration difficulties. The court determined that these symptoms, when considered in combination, constituted a pathological and somatically objectively verifiable state; however, the BGH concluded that a correction of the conviction was not legally warranted, reaffirming that a General Prosecutor's request for amendment which the court declines to follow does not preclude the dismissal of the appeal via interlocutory order under Section 349 Paragraph 2 of the Code of Criminal Procedure.

Volltext
BGH, Beschluss vom 7. November 2023 – 5 StR 355/23 mwN).
