BGH: Denial of revision leave for lack of fundamental legal significance in civil dispute
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) 11th Civil Senate rejected the plaintiff's application to stay proceedings and dismissed the plaintiff's appeal on non-acceptance against a decision of the Stuttgart Higher Regional Court, ordering the plaintiff to bear the costs of the appellate proceedings; the dispute concerned a civil matter where the plaintiff challenged a lower court's refusal to accept its appeal for revision, but the court found that the case lacked fundamental legal significance and did not require the development of law or the assurance of uniform jurisprudence; the decision relied on § 543 Abs. 2 Satz 1 ZPO (German Code of Civil Procedure) and § 544 Abs. 6 Satz 2 Halbs. 2 ZPO, with the substantive reasoning referencing a prior BGH judgment dated February 27, 2024, thereby leaving the underlying lower court decision in force.
