The Federal Court of Justice (BGH), 11th Civil Senate, determined the primary respondent to the representative appeal and ordered a public announcement in the claim register regarding the filing of the legal appeal. The dispute arose in a model proceedings (Musterfeststellungsklage) concerning a prospectus, where the representative plaintiff and four associated parties filed a Rechtsbeschwerde against the model judgment issued by the Hanseatic Higher Regional Court. The court ordered that the entity that signed the prospectus as the responsible party be designated as the representative respondent pursuant to § 21 Abs. 1 Satz 2 KapMuG, while any further co-respondents would remain involved only if they formally joined the proceedings within the statutory deadline. The decision was based on the requirements of §§ 20 and 21 KapMuG, confirming that the formal and temporal prerequisites for filing the representative appeal were met, thereby triggering the mandatory public notification under § 20 Abs. 2 KapMuG.
