Admissibility of appeal against higher regional court decision in enforcement matters; lack of statutory appellate chain
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's filing, labeled as a "Klage," as inadmissible and awarded costs to the opposing party. The dispute concerned the enforcement of a judgment, specifically the debtor's challenge against his registration in the debtors' register, which had been upheld by the local court and subsequently rejected by the district court and the higher regional court. The court determined that the filing was procedurally defective because, in enforcement matters, the district court serves as the appellate instance for the local court's decision; since the higher regional court and the Federal Court of Justice are not part of the authorized appellate chain for such matters, the debtor's attempt to appeal to the highest court was barred. The ruling is based on §§ 574(1) no. 2 and 577(1) sentence 2 ZPO, which restrict the admissibility of the Rechtsbeschwerde to cases where the appellate court has explicitly granted leave to appeal, a condition that was not met.

Beschwerdeinstanz in Zwangsvollstreckungssachen
[TENOR]
III. Die Kostenentscheidung beruht auf § 97 Abs. 1 ZPO.
