Inadmissibility of legal complaint in debt enforcement due to missing leave to appeal
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the debtor's legal complaint as inadmissible, ordering that it be rejected at the debtor's expense, thereby leaving the Lower Regional Court's decision in force. The dispute concerned a debt enforcement matter where the debtor challenged a ruling from the Lower Regional Court of Marburg, which had refused to permit the legal complaint. The decisive legal basis was § 574(1) no. 2 and § 577(1) sentence 2 ZPO (new version), under which a legal complaint is inadmissible if not explicitly granted by the lower court; the Court further clarified that the refusal to grant leave for appeal is not itself subject to review and that no extraordinary or constitutional appeal route is available in such instances.
