Insurance dispute: No need for EU pre-referral on good-faith defense or policy-model compliance where issues are not decisive
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff’s complaint against the non-admission of revision, thereby upholding the lower court’s judgment and leaving the prior decision in force. The dispute, valued at approximately €22,324, concerned an insurance claim where the plaintiff alleged that the insurance policy model violated EU directives and that the insurer’s defense based on the principle of *venire contra factum proprium* (good faith) required a preliminary reference to the Court of Justice of the European Union. The court held that neither the compliance of the policy model with EU directives nor the good faith argument was decisive for the outcome of the case, and thus no reference to the EU Court was necessary, finding no fundamental legal significance or need to unify jurisprudence under § 543(2) sentence 1 German Code of Civil Procedure.
