Non-admission of revision in insurance dispute: necessity of CJEU preliminary reference on policy directive compliance and good faith
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of revision, resulting in the Lower Regional Court's judgment remaining in force and the plaintiff bearing the costs. The dispute concerned insurance policy claims, specifically the compatibility of a policy model with EU directives and the application of the doctrine of good faith, where the plaintiff attempted to secure a reference to the Court of Justice of the European Union. The court held that the directive compliance was not decisive for the outcome and that the good faith issue did not require a preliminary reference, nor did the case possess fundamental significance or need for legal development under Section 543 (2) Sentence 1 of the Code of Civil Procedure, while the alleged violation of the right to be heard under Article 103 (1) of the Basic Law was found to be unfounded.
