The German Federal Court of Civil Procedure dismissed the plaintiff's complaint against the non-admission of the constitutional appeal (Revisionsbeschwerde), upholding the appellate court's judgment in favor of the defendant. The dispute concerned a tort claim based on § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the Food Law Regulation (EG-FGV), where the appellate court had denied liability on the grounds that the defendant lacked fault (Verschulden). The Court of Revision held that the case did not have fundamental significance nor require legal development or uniform application of law, thereby finding no valid grounds for admitting the appeal. The plaintiff was ordered to bear the costs of the complaint proceedings, with the amount in dispute set at 30,000 €.

Volltext
