Termination of notarial disciplinary proceedings for mootness and cost allocation under BNotO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) terminated the proceedings based on the parties' joint declaration that the main case was moot after the defendant dismissed the plaintiff from office effective May 1, 2022, thereby rendering the first-instance judgment of the Higher Regional Court of Celle ineffective and offsetting the costs of both instances against each other. The dispute concerned a notary’s action challenging his removal from office and the appointment of a notarial administrator by the competent disciplinary authority, a decision originally grounded in § 50(1) No. 8 BNotO. Although the court did not reach a substantive ruling on the merits, it noted that the success of the appeal was uncertain due to the need to resolve complex legal issues, including questions regarding Article 80(1) sentences 3 and 4 of the German Basic Law, which precluded a determination of hypothetical chances of success for cost purposes under § 161(2) VwGO applied via § 111b BNotO.

[GRUENDE]
4. Der Streitwert ergibt sich aus § 111g Abs. 2 Satz 1, Abs. 1 Satz 1 BNotO iVm § 52 Abs. 2 GKG.
