Admission of revision to BGH in motor emissions dispute: standing of engine manufacturer for intentional tort and statutory violation
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Civil Procedure (BGH) dismissed the plaintiff’s non-admission complaint, upholding the Oberlandesgericht Köln’s judgment and leaving the lower court’s ruling in force. The dispute concerned a civil claim for damages in a product liability context, where the plaintiff alleged intentional tortious conduct and statutory violations by a motor manufacturer in relation to vehicle emissions. The court held that the plaintiff failed to demonstrate the requisite grounds for admission of an appeal on points of law, specifically failing to show the decision-relevance of the claimed legal errors or a sufficient basis for a claim under §§ 826, 31 BGB regarding an intentional breach of law by the vehicle manufacturer in which the motor manufacturer could have participated. The court also rejected the alleged violations of procedural fundamental rights, relying on § 543 Abs. 2 Satz 1 ZPO for the dismissal and § 544 Abs. 6 Satz 2 ZPO to waive a further detailed reasoning.
