The Federal Court of Criminal Justice granted the defendant's application for reinstatement of rights, restoring the status ante to cure the expiration of the deadline to file an appeal against the lower court's judgment, and ordered that the deadline to submit the grounds for appeal begins upon service of this order. The dispute concerned a procedural default where the defendant's counsel failed to file the appeal within the one-week period prescribed by law, though the counsel subsequently demonstrated that the defendant was not at fault for the delay and that the omitted act was performed in a timely manner after the deadline had lapsed. The decision is grounded in §§ 45(1) sentence 1 and 46(1) of the Code of Criminal Procedure (StPO), which allow for reinstatement when lack of fault is established and the missed procedural step is validly performed, confirming that no return of the case files to the lower court is required because a complete judgment had already been effectively served.

BGH, Beschluss vom 9. November 2022 – 5 StR 362/22 mwN).
