The Federal Court of Justice (Ist Civil Senate) rejected the applicant’s request for legal aid to pursue a further appeal against a decision of the Düsseldorf Higher Regional Court. The dispute concerned an attempt to challenge a decision of the appellate court (Beschwerdegericht) made on December 14, 2023. The court determined that the intended legal action had no reasonable prospect of success because no admissible legal remedy lay against the appellate court's decision. Specifically, a free-standing legal appeal (Rechtsbeschwerde) was not available under § 70(3) FamFG, nor had the appellate court granted permission for such an appeal under § 70(1) FamFG; the court noted that the non-granting of permission is not independently challengeable. The decision relied on §§ 5, 76 FamFG and § 114(1) ZPO in conjunction with § 5 of the Legal Aid Act (BerHG).

Volltext

BGH, Beschluss vom 3. Januar 2024 - I ZB 85/23, juris Rn. 2 mwN).
