Refusal to admit revision due to lack of fundamental legal significance where administrative fault is absent
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) rejected the plaintiff's complaint against the refusal to admit revision, upholding the Munich Higher Regional Court's judgment in favor of the defendant; the plaintiff bears the costs of the complaint proceedings. The case involved a civil dispute where the plaintiff attempted to raise a question of fundamental legal significance, potentially requiring a preliminary reference to the Court of Justice of the European Union, which was dismissed as not decision-relevant. The decisive legal basis was § 543 Abs. 2 Satz 1 ZPO (requirements for admitting revision) and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO (simplified reasoning), applied on the grounds that the lower court had already established the absence of fault on the part of the defendant's employees, rendering the contested legal issue moot.

November 2022 - III ZR 308/20, juris Rn. 2).
