Non-allowance of revision for lack of basic legal significance in civil dispute
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-allowance of revision, thereby upholding the lower court's procedural ruling and leaving the judgment of the 3rd Civil Senate of the Cologne Higher Regional Court in force; in doing so, the court also rejected the claimed violations of fundamental procedural rights and ordered the defendant to bear the costs of the appeal proceedings. The dispute concerned a civil matter where the defendant challenged the lower court's refusal to grant leave for appeal on grounds of basic legal significance or the need for consistent jurisprudence, with the appellate court assessing the prospects of success of a potential revision without finding it meritorious. The decision was grounded in § 543 Abs. 2 Satz 1 ZPO, which governs the requirements for allowing revision, and § 544 Abs. 6 Satz 2 Halbsatz 2 ZPO, which permitted the court to omit a detailed reasoning as it would not contribute to clarifying the prerequisites for admitting a revision.
