Admissibility of revision complaint citing fundamental significance and Art. 267 TFEU in civil proceedings
Legislator-Zusammenfassung
KI-generiertThe BGH 6th Civil Senate dismissed the plaintiff's complaint against the non-admission of revision, thereby upholding the OLG Dresden judgment of June 5, 2023, and ordering the plaintiff to bear the costs of the complaint proceedings. The dispute concerned a civil matter where the plaintiff attempted to establish that the case possessed fundamental significance, specifically by alleging violations of procedural fundamental rights and referencing Art. 267 TFEU, to compel a review by the Federal Court of Justice. The court held that the complaint failed to demonstrate a decisive legal issue or the necessity for legal development under § 543 Abs. 2 ZPO, finding the alleged procedural violations non-substantive, and declined to provide a detailed reasoning in accordance with § 544 Abs. 6 ZPO, with the matter's value capped at €40,000.

KI-generiertMain legal basis for dismissing the complaint against the non-admission of revision due to the lack of fundamental significance or need for uniform jurisprudence.
Procedural basis for waiving the detailed reasoning in the decision as it would not contribute to clarifying the prerequisites for admitting revision.
Legal basis for ordering the plaintiff to bear the costs of the complaint proceedings.
