Failure to demonstrate fundamental significance for admissibility of non-admission complaint against tort claim under § 823 Abs. 2 BGB and Food Safety Act
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Justice (BGH) dismissed the plaintiff's non-admission complaint, upholding the appellate court's denial of the claim and awarding the defendant the costs. The dispute concerned a claim for tortious liability under § 823 Abs. 2 BGB in conjunction with § 6 Abs. 1 and § 27 Abs. 1 of the German Food Safety Act (EG-FGV), where the plaintiff argued that the appeal court's reasoning failed to meet the threshold for admission to revision on grounds of fundamental legal significance or legal development. The BGH held that the complaint was inadmissible because the plaintiff failed to sufficiently demonstrate the decision-relevance of the raised legal questions, as the lower court's rejection of the claim was independently grounded on the finding of an absence of fault (Verschuldensmangel), which did not require further clarification by the supreme court.
