Timeliness of appeal justification in narcotics aiding case: application of § 43 StPO deadline extension rules and status of non-public holidays
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice’s Second Criminal Senate dismissed the defendant’s appeal as inadmissible, leaving the Landgericht Limburg’s judgment of November 29, 2021, in force, which convicted the defendant of aiding and abetting the unlawful dealing with narcotics in non-exceptional quantities and imposed a one-year suspended prison sentence with confiscation of secured funds. The dispute centered on the timeliness of the appeal justification, where the defendant argued compliance with statutory deadlines following a granted readmission to the original status for filing the appeal. The court ruled that the one-month deadline for justifying the appeal under Section 345(1) of the Code of Criminal Procedure began upon service of the readmission order on July 13, 2022, and, pursuant to Sections 43(1) and 43(2) of the Code of Criminal Procedure, expired on Monday, August 15, 2022, as the deadline fell on a Saturday and the intervening holiday of August 15 was not a public holiday under federal or Hessian state law; since the justification was only received by the lower court on August 16, 2022, it was filed late, rendering the appeal inadmissible under Section 349(1) of the Code of Criminal Procedure.

BeckOK StPO/Cirener, 44. Ed., Stand: 1. Juli 2022, § 43 Rn. 2) – in Hessen landesgesetzlicher Feiertag ist (§ 1 Abs. 1 HFeiertagsG).“
