Criminal sentencing weight of full factual confession despite "partial admission" characterization
Legislator-Zusammenfassung
KI-generiertThe German Federal Court of Criminal Third Senate dismissed the defendant's appeal as unfounded, leaving the lower court's conviction and sentence in force, while noting an error in the lower court's description of the defendant's plea. The dispute concerned a criminal appeal against the Landgericht Kleve's judgment, challenging the adequacy of sentencing based on the weight given to the defendant's confession; material facts indicate the defendant had admitted both objective and subjective elements of the offense despite the trial court's misleading characterization of the plea as "partially guilty." The decisive legal basis was Section 349(2) of the Code of Criminal Procedure, under which the appellate court found no legal error to the defendant's detriment, including no constitutional violation regarding the insufficient consideration of the confession during sentencing.

Oktober 2014 - 2 StR 36/14, NStZ-RR 2015, 16).
