Lawyer Admission Admission: Right to Be Heard Not Violated by Rejection of Legal Arguments or Unresolved Guardianship Status
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice’s Panel for Attorney Matters dismissed the plaintiff’s objection to hearing (Anhörungsrüge) against the panel’s order of April 10, 2026, rejecting the claim that the right to be heard was violated and leaving the underlying decision on the admissibility of the admission application intact. The dispute concerned a lawyer’s application for admission and the plaintiff’s argument that the court failed to consider her legal submissions or account for her status under legal guardianship due to lack of a valid address for service. The court held that the panel had fully reviewed the plaintiff’s arguments but rightly rejected their legal merit, clarifying that a refusal to follow a party’s legal interpretation does not violate Article 103(1) of the Basic Law; it further noted that the termination of guardianship under § 287(1) FamFG takes effect upon notification to the guardian, not public announcement, rendering the plaintiff’s procedural excuse invalid under § 112c(1) BRAO and § 152a(1) No. 2 VwGO.
