The German Federal Court of Justice (BGH) rejected the defendant's appeal as unfounded, upholding the Landgericht Kleve's conviction from April 6, 2022, and ordering the defendant to bear the costs of the legal remedy. The case involved a criminal appeal challenging the trial court's assessment of the defendant's maturity, specifically whether the individual exhibited a developmental delay. The BGH determined that although the lower court used a questionable formulation stating that a "maturity delay of almost three years" was to be excluded, this did not constitute a fatal legal error because the court effectively and substantively found that the defendant exhibited no maturity delay whatsoever. The decision stands on the basis of § 349 Abs. 2 StPO, confirming that no legal error to the defendant's detriment was identified during the review.
