Engine Manufacturer Tort Liability: Insufficient Allegation of Vehicle Manufacturer's Intentional Legal Violation
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice dismissed the plaintiff's complaint against the non-admission of appeal, upholding the lower appellate court's judgment in favor of the defendant. The dispute involved a manufacturer of vehicle engines alleging damages under tort law, specifically intentional tort (§ 826 BGB combined with § 31 BGB) and statutory violation (§ 823(2) BGB in conjunction with engine emission regulations), against which the appellate court had ruled. The Supreme Court found no grounds for admission because the plaintiff failed to adequately demonstrate a potential intentional legal violation by the vehicle manufacturer with which the engine manufacturer could have acted in concert, referencing precedent regarding the strict requirements for liability of component suppliers, and deemed the alleged procedural rights violations non-irrelevant. Consequently, the appellate court's rejection of the claims remains in force, and the plaintiff bears the costs of the proceedings.
