Admissibility of non-admission appeal based on alleged need for preliminary reference on damages proof and procedural fundamental rights
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Civil Procedure rejected the plaintiff's non-admission appeal, thereby upholding the appellate court's decision and dismissing the request to stay the proceedings; the plaintiff is ordered to bear the costs of the appeal, with the disputed value capped at €65,000. The dispute concerned the establishment of damages, where the plaintiff argued that the appeal should have been admitted to clarify issues potentially accessible to the Court of Justice of the European Union under Article 267 TFEU. The court held that the appellate decision was independently based on reasoning regarding the proof of damages that did not fall within the scope of preliminary reference questions, and no fundamental breach of procedural rights was substantiated, leading to the refusal to admit a revision under Section 543(2) Sentence 1 of the Code of Civil Procedure.
