Juvenile dangerous bodily harm: mandatory supplemental adhesion ruling for partially granted pain compensation under § 406 Abs. 1 Satz 3 StPO
Legislator-Zusammenfassung
KI-generiertThe defendant's revision against the Landgericht Bad Kreuznach judgment of 9 July 2025 was rejected as unfounded under § 349 Abs. 2 StPO, with the court solely supplementing the operative part to explicitly note that the remainder of the adhesion claim was not decided. The case involved a juvenile convicted of dangerous bodily harm (*gefährliche Körperverletzung*) to a two-year and nine-month juvenile sentence, along with a civil adhesion award of €2,500, which the defendant appealed alleging violations of formal and substantive law. The Bundesgerichtshof held that because the court awarded less than the €3,000 minimum claimed by the co-plaintiff, it was legally required to explicitly record the partial waiver of the remaining adhesion decision pursuant to § 406 Abs. 1 Satz 3 StPO; consequently, the original conviction and adhesion award remain in force, and the defendant bears the costs of the revision, special adhesion costs, and necessary disbursements of the co-plaintiffs under §§ 473 Abs. 4 and 472a Abs. 2 StPO.

Volltext
