HOAI minimum fee rates under EU competition law; estimation of claim amount under § 287 Abs. 2 ZPO
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the defendant's complaint against the non-admission of revision, thereby upholding the final judgment of the Frankfurt Higher Regional Court and leaving the defendant liable for the costs of the complaint proceedings. The dispute concerned the validity of minimum fee rates under the German Fee Ordinance for Architects (HOAI) and their compatibility with EU competition law, alongside a challenge to a specific estimate regarding the calculation of the awarded claim. The court held that the admissibility grounds were no longer present because the relevant legal question on HOAI minimum fees had been definitively resolved by a prior BGH decision dated November 3, 2022, which also established that the defendant's substantive revision arguments lacked success; furthermore, the appellate court's estimation of the claim amount was deemed legally valid under Section 287(2) of the Code of Civil Procedure, rendering further reasoning unnecessary under Section 544(6) Sentence 2 of the Code of Civil Procedure.

Halbsatz ZPO).
Der Beklagte trägt die Kosten des Beschwerdeverfahrens (§ 97 Abs. 1 ZPO).
