Form requirements for third-party consent in municipal pre-emption right under § 27a(1)(1) BauGB
Legislator-Zusammenfassung
KI-generiertThe Federal Court of Justice (BGH) dismissed the complainant's application for leave to file a revision appeal, upholding the lower court's decision that the exercise of the municipal pre-emption right was legally barred. The dispute concerned the validity of a municipal pre-emption right exercised for the benefit of a third party, specifically challenging whether the third party's declaration of consent and obligation required a specific written form under § 11(3) BauGB or could be made unilaterally and informally. Relying on the unchallenged factual findings that the statutory conditions for pre-emption were not met, the BGH held that the right was excluded under § 26(4) BauGB, rendering the complainant's arguments regarding the formal requirements of § 27a(1)(1) BauGB irrelevant to the outcome. The BGH rejected the argument that the lower court's interpretation—that such declarations require a written agreement—necessitated further legal clarification, as the case could be resolved on the basis of the exclusion provision. Consequently, the complainant bears the costs of the proceedings, and the lower court's judgment remains in force.
